ATLANTA (Legal Newsline) — A Montana woman filed a class action complaint against Delta Air Lines in April over the company offering customers credit instead of refunds for flights that were canceled due to the COVID-19 outbreak.
Angela Dusko, on behalf of herself and all others similarly situated, filed the complaint April 22 in the U.S. District Court for the Northern District of Georgia against Delta Airlines Inc., alleging breach of contract and other claims.
Dusko alleged that Delta violated its cancellation and refund provisions of its "Contract of Carriage" by refusing to issue refunds to passengers whose flights were canceled due to the coronavirus outbreak, according to the complaint. Dusko originally purchased tickets for herself and her husband on Dec. 11, 2019, to travel to Cancun, Mexico, on March 27.
The plaintiffs seek monetary relief, a trial by jury, interest and all other just relief, according to the complaint.
