NEW YORK (Legal Newsline) — An undergraduate student at Long Island University has filed a class action alleging he and other students are entitled to a tuition refund due to the COVID-19 outbreak campus closure.
Nicolas Irizarry, on behalf of himself and all others similarly situated, filed a complaint April 21 in the U.S. District Court for the Southern District of New York against Long Island University, alleging breach of contract, unjust enrichment and conversion.
Irizarry is a student who enrolled in classes for Long Island University's spring 2020 semester. He claims he and other students are entitled to tuition refunds due to the campus Coronavirus closure on March 11. Irizarry alleges the university has not delivered the educational services, facilities or opportunities they paid for and that the remote learning is not equivalent to in-person instruction.
Irizzary seeks monetary relief of more than $5 million for the class, interest, trial by jury and all other just relief. He is represented by Joseph Marchese and Sarah Westcot of Bursor & Fisher PA in New York and Miami.
