SAN FRANCISCO (Legal Newsline) — StubHub is facing a class action from consumers over its decision to not refund money for canceled events due to the COVID-19 outbreak.
Jason Alcaraz, individually and on behalf of all others similarly situated, filed a complaint April 14 in the U.S. District Court for the Northern District of California against StubHub Inc., alleging breach of express warranty, negligent misrepresentation and other claims.
Alcaraz had purchased tickets to the Snoh Aalegra tour, which was cancelled due to the COVID-19 outbreak. He alleges StubHub has backed out of its "FanProtect" guarantee to give customers a refund for event cancellations but instead offered a 120 percent coupon off customers' original StubHub order. Alcaraz claims he informed StubHub in writing that he had lost his job and had no interest in using a coupon.
Alcaraz seeks monetary relief, trial by jury, interest and all other just relief. He is represented by L. Timothy Fisher and Yeremey Krivoshey of Bursor & Fisher in Walnut Creek, California and Scott Bursor of Bursor & Fisher in Miami.
