SAN FRANCISCO (Legal Newsline) — Nestlé USA is facing a class action alleging its Nesquik products have been artificially or synthetically processed despite the "no artificial flavors or colors" labeling on its packaging.
Michael Santini, on behalf of himself and all others similarly situated and the general public, filed a complaint April 9 in the U.S. District Court for the Northern District of California against Nestlé and Does 1 through 10, alleging violation of California law, breach of express warranty, fraud and other claims.
Santini alleges in the complaint that Nestlé's "no artificial flavors or colors" labeling on its Nesquik products is false and deceptive to consumers because ingredients such as cocoa have been "processed to change the flavoring and coloring" or have undergone a "chemical process" that changes the composition of its natural state.
The plaintiff and class seek monetary relief of more than $5 million, interest, trial by jury and all other just relief. They are represented by Reuben Nathan of Nathan & Associates APC in Newport Beach, Calif.
