Almond milk uses fake vanilla, lawsuit says

NEW YORK (Legal Newsline) - Orgain Inc. misled consumers by labeling its almond milk drinks as “vanilla” when they were actually flavored with non-vanilla ingredients, according to a class action lawsuit.

“Though the characterizing flavor is represented as vanilla, the vanilla taste and flavor is not provided exclusively by vanilla beans,” according to the Feb. 7 complaint.

The demand for vanilla is triple that of all other flavors combined, the suit said.

“This demand could not be met by natural sources of vanilla, leading manufacturers to devise clever, deceptive and dangerous methods to imitate vanilla’s flavor and appearance,” the suit states.

Orgain sold more and charged higher prices for its products by misleading consumers, the lawsuit alleges. "Had plaintiffs and class members known the truth, they would not have bought the products or would have paid less for it," the suit says.

The complaint was filed by Herbie Hamilton on behalf of other consumers who purchased the product. He is represented by Spencer Sheehan.
