Group alleges Owens-Illinois' California plant is violating Clean Air Act

FRESNO, Calif. (Legal Newsline) – The owners and operators of a glass container manufacturing plant in the San Joaquin Valley is facing allegations of Clean Air Act violations by a nonprofit pollution prevention group.

Association of Irritated Residents (AIR) filed a complaint Dec. 6 in the U.S. District Court for the Eastern District of California against Owens-Illinois Inc. alleging violation of the Clean Air Act.

AIR alleges in its complaint that Owens-Illinois' glass manufacturing plant located in Tracy, California, is "exceeding the opacity emissions limits" and CO emissions limits. AIR also alleges Owens-Illinois has failed to "vent its exhaust" by controlling its equipment. 

AIR seeks civil penalties of $37,500 per day for each violation proven before Nov. 2, 2015, and $47,357 per day for each violation proven after Nov. 2, 2015, and other just relief.
