A 'massive false advertising scheme' is alleged in lawsuit against Old Navy

SEATTLE (Legal Newsline) – Old Navy is facing a lawsuit filed by a Washington state woman alleging the retailer entices customers through an advertising scheme that includes inflated discounts and reference prices. 

Anna Nemykina, for herself as private attorney general and/or on behalf of all others similarly situated, filed a complaint Dec. 1 in the U.S. District Court for the Western District of Washington against Old Navy LLC, GPS Services Inc., The Gap Inc., and Does 1-20 inclusive alleging violation of the Washington Consumer Protection Act, the California Consumers Legal Remedies Act, California False Advertising Law and the California Unfair Competition Law.

Nemykina alleges Old Navy's $7.2 billion annual U.S. sales are a result of a "massive false discount advertising scheme." She claims in her suit that through its stores and website, Old Navy lists "discounts and reference prices" that are false "because Old Navy rarely if ever offers the products at the advertised list price." Nemykina also claims Old Navy "invents" inflated and false "list prices out of thin air" in order to entice customers to buy its products. 

Nemykina seeks restitution or disgorgement, injunctive relief, a trial by jury and all other just relief.
