SAN BERNARDINO, Calif. (Legal Newsline) – A California man alleges a Chinese cuisine restaurant chain has employed a "bait and switch" on its customers by falsely labeling some menu items as containing crab meat.

Chansue Kang filed a complaint Oct. 24 in the San Bernardino County Superior Court against P.F. Chang's China Bistro Inc. alleging violation of Business & Professions Code, the Consumer Legal Remedies Act, breach of express warranty and violation of consumer fraud laws.

Kang claims in his class action that P.F. Chang's is practicing unfair and deceptive practices with its "Krab Mix" menu, which includes Kung Pao Dragon Roll, Shrimp Tempura Roll and the California Roll. Kang alleges that the restaurant represents "the Krab Mix in the food products resembles crab meat, is equivalent to crab meat, and/or contains crab meat," the suit states.

He alleges that "no crab meat exists and the Krab Mix is nutritionally inferior to crab meat." The suit states imitation crab meat is used in the products.

Kang seeks compensatory and punitive damages, a trial by jury, interest and all other just and proper relief. He is represented by Stephanie Yasuda, Kenneth H. Yoon and Brian G. Lee of Yoon Law APC; Preston Lim of Lim Law Group PC; and Jong Kim of The Law Offices of Jong Yun Kim, all in Los Angeles.

The defendant removed the case to the U.S. District Court for the Central District of California on Nov. 25.
