DETROIT (Legal Newsline) – A former Cook's Illustrated magazine subscriber alleges he now receives junk mail because the magazine's publisher sold his information to data aggregators.
Steven Kittle, individually and on behalf of all others similarly situated, filed a complaint on June 13 in the U.S. District Court for the Eastern District of Michigan against America’s Test Kitchen LP alleging violation of the Preservation of Personal Privacy Act and unjust enrichment.
The plaintiff alleges that he was a subscriber to Cook’s Illustrated magazine in 2016, which is published by the defendant. The plaintiff alleges he was unaware that the defendant was in the practice of selling subscribers’ personal information to third parties. He alleges he now receives junk mail because of the defendant's actions.
The plaintiff alleges that he would not have given personal information to the defendant had he known that it was going to be sold.
The plaintiff is seeking a trial by jury, interest, an order of restitution, judgment against the defendant, injunctive relief and other relief deemed fit, as well as attorneys’ fees and costs of the suit.
