New England Fat Loss 2 alleged to have sent unwanted telemarketing texts

BOSTON (Legal Newsline) – Two individuals are suing a weight loss company over allegations it sent them unlawful telemarketing text messages.

David Gaffin and Christian Lopez, individually and on behalf of all others similarly situated, filed a complaint on May 31 in the U.S. District Court for the District of Massachusetts against New England Fat Loss 2 Inc. alleging violation of the Telephone Consumer Protection Act.

Gaffin alleges his number has been on the National Do Not Call Registry for years. Both plaintiffs allege the defendant sent them text messages advertising its services without their consent. Gaffin alleges he received the texts in April.

The plaintiffs are seeking a trial by jury, injunctive relief against the defendant, punitive damages of $500 for each violation and up to $1,500 per violation that was knowingly committed and other relief deemed fit. They are represented by Anthony I. Paronich of Paronich Law PC in Hingham, Massachusetts, and Alex M. Washtowitz and Jeremy Cohen of CW Law Group PC in Framingham, Massachusetts.
