Ketone capsules don't help you lose weight, says lawsuit by upset consumer

NEW YORK (Legal Newsline) – A man is filing a class action lawsuit against a weight loss product company alleging that the product he purchased has no ability to aid weight loss.

Chaim Rubinstein, individually and on behalf of all others similarly situated, filed a complaint on April 24 in the U.S. District Court for the Southern District of New York against Weight Loss Products LLC and its managing member Beth Golden, alleging false and misleading labeling and advertising.

The suit states Weight Loss Products sells RK Pure Raspberry Ketone capsules and advertises the product as a "fat burner," "natural" and "100 percent natural." The suit states the plaintiff purchased the product based on these misrepresentations.

The plaintiff alleges these representations are false.

"In fact, neither formula specifically nor raspberry ketones generally have been validated as a 'fat-burner' in human beings, contrary to WLP’s many representations. Nor is the Formula 'Natural' or '100 percent natural,'" the suit states.

The plaintiff is seeking a trial by jury, statutory damages, actual and punitive damages, attorneys' fees and costs. The plaintiff is represented by Mark Schlachet of the Law Offices of Mark Schlachet in Cleveland.
