LOS ANGELES — A California couple is suing a debt collection agency, alleging that they were repeatedly called.
James McCarver and Dianna McCarver filed a complaint April 19 in U.S. District Court for the Central District of California against Prosper Funding LLC., alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the McCarvers began to receive calls from Prosper Funding on a regular basis, sometimes receiving multiple calls in a single day. The plaintiffs have requested that the calls cease but the defendant has failed to stop, the suit says.
The McCarvers seek trial by jury, up to $1,500 for every violation, and up to $500 in statutory damages for every violation, an injunction against the defendant and all other just and proper relief. They are represented by attorney Matthew C. Bradford of Robinson Bradford LLP in Stockton.
