IDT Energy alleged to have called numbers listed on Do-Not-Call registry to market services

CHICAGO (Legal Newsline) – Residents of Illinois and New Jersey allege a New Jersey energy service provider harassed them with marketing calls.

Scott Mackey and Daniel Hernandez filed a complaint individually and on behalf of all others similarly situated on Oct. 5 in the U.S. District Court for the Northern District of Illinois against IDT Energy Inc. citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that in March and May, the defendant called them for telemarketing purposes regarding its products and services. They allege that both of their numbers are registered on the National Do-Not-Call Registry and they requested the defendant to stop contacting them to no avail.

The plaintiffs hold IDT Energy Inc. responsible because the defendant allegedly made calls to cellphone numbers with the use of an automatic telephone dialing system and without their consent.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, certification of the suit as a class action, declaratory relief, attorneys’ fees and costs, and further relief as the court deems necessary.
