Consumer alleges Ticketmaster works with resellers to get 'second cut' on ticket sales

SAN FRANCISCO (Legal Newsline) – A California man alleges Ticketmaster has been working with ticket scalpers and has facilitated ticket sales by implementing a resale partner program.

Allen Lee filed a complaint on behalf of himself and all others similarly situated on Sept. 28 in the U.S. District Court for the Northern District of California against Ticketmaster LLC and Live Nation Entertainment Inc. alleging violation of common law of unjust enrichment and other counts.

"Ticketmaster has actually facilitated the sale of tickets to the secondary market by secretly implementing a 'Resale Partner Program' supported by TradeDesk, which Ticketmaster acknowledges it 'built expressly for professional resellers.' And Ticketmaster does this in order to receive a second cut on tickets—that is even more than the original cut Ticketmaster receives," the complaint states.

The complaint states that this is unfair to consumers who typically pay more for tickets when buying on the secondary market.

The plaintiff holds Ticketmaster LLC and Live Nation Entertainment Inc. responsible because the defendants allegedly engaged in unlawful and unfair business acts and practices.

The plaintiff requests a trial by jury and seeks judgment against the defendant, maintain the suit as a class action, award restitution of all monies, attorney's fees, costs, and further relief as the court may deem just.
