New Hampshire city's wastewater treatment facility violates Clean Air Act, government alleges

CONCORD, N.H. (Legal Newsline) – The federal government alleges a New Hampshire municipality's wastewater treatment facility is operating in violation of federal law.

The United States of America, acting at the request of the administrator of the United States Environmental Protection Agency, filed a complaint on Sept. 11 in the U.S. District Court District of New Hampshire against the city of Manchester, New Hampshire citing the Clean Air Act.

According to the complaint, the plaintiff alleges that the defendant has violated the sewage sludge incinerator standards and regulations of the Clean Air Act.

The plaintiff holds the city of Manchester, New Hampshire responsible because the defendant allegedly failed to file a final control plan by the final compliance date of March 21, 2016, and failed to achieve final compliance by the deadline.

The plaintiff seeks to enjoin the defendant from operating the facility, assess defendant civil penalties of up to $97,229 per day for each CAA violation, award the United States all costs and disbursements of this action; and grant such other relief as the court deems just and proper. It is represented by Jeffrey H. Wood and Peter K. Kautsky of U.S. Department of Justice in Washington, D.C.
