Man alleges text messages from Florida yoga studios invaded privacy

FORT LAUDERDALE (Legal Newsline) – Two Florida yoga studios are alleged to have unlawfully sent unsolicited text messages for marketing purposes.

Daniel Mittelmark filed a complaint individually and on behalf of all others similarly situated on Sept. 11 in the U.S. District Court for the Southern District of Florida against The Yoga Joint South LLC and Yoga Joint - Deerfield LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges in June and July, the defendant sent him marketing-related text messages. He alleges he did not provide the defendants with his consent to receive the texts and that his privacy was invaded as a result.

The plaintiff holds The Yoga Joint South LLC and Yoga Joint - Deerfield LLC responsible because the defendants allegedly failed to obtain express permission from the called party and unlawfully utilized an automatic telephone dialing system to make non-emergency contact via phone.

The plaintiff requests a trial by jury and seeks judgment against the defendants; declaratory and injunctive relief; award of actual, statutory, and treble damages; and other relief the court deems reasonable. He is represented by Manuel S. Hiraldo of Hiraldo PA in Fort Lauderdale, Florida.
