Bob's Red Mill steel cut, old fashioned oats alleged to contain herbicide glyphosate

SAN FRANCISCO (Legal Newsline) – Two California consumers allege Bob's Red Mill oat products contain an herbicide.

Tamara Frankel and Natasha Paracha, on behalf of themselves and all others similarly situated, filed a complaint on Aug. 31 in the U.S. District Court for the Northern District of California against Bob's Red Mill Natural Foods Inc. over alleged violation of the Consumers Legal Remedies Act and Unfair Competition Law.

According to the complaint, the plaintiff purchased the defendant's steel-cut oats and old fashioned rolled oats based on the defendant's marketing that the products are whole grain and "purity tested."

However, the plaintiffs allege recent testing by Environmental Working Group revealed that the products contain glyphosate, an herbicide used in the United States. The plaintiffs allege that had they known this information, they would not have purchased the products.

The plaintiffs hold Bob's Red Mill Natural Foods Inc. responsible because the defendant allegedly failed to disclose its products contain or likely contain glyphosate and continues to sell the products in packages omitting the information.

The plaintiffs request a trial by jury and seek award of restitution, disgorgement, attorneys' fees, costs and such further relief as may be just and proper. They are represented by Patricia N.
