Certain flavors of Campbell's Soups are not preservative free as labeled, consumers allege

BELLEVILLE, Ill. (Legal Newsline) – Two Illinois consumers allege some flavors of Campbell's Soup are falsely represented that they do not contain preservatives.

Danielle Schwartz and Haunah Vanlaningham filed a complaint on behalf of all other similarly situated current citizens of Illinois on June 21 in the Circuit Court for the 20th Judicial Circuit County of St. Clair against Campbell Soup Co. alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiffs allege that on several and separate occasions in 2018, they purchased the defendant's Slow Kettle Style Tomato & Sweet Basil Bisque and Home Style Harvest Tomato with Basil Soup after reviewing the products' labels that stated they were made without preservatives. They allege the soups do contain preservatives because they contain citric acid, ascorbic acid and/or succinic acid.

The plaintiffs hold Campbell Soup Co. responsible because they allege they were deceived by the preservative-free labels on the soups and were damaged.

The plaintiff seeks compensatory damages or alternatively require defendant to disgorge or pay restitution of its ill-gotten wealth, pre- and post-judgment interests, attorney's fees and costs of suit.
