Texas law firm alleges it was not paid fees after obtaining settlement in New York case

BROOKLYN, N.Y. (Legal Newsline) – A Texas law firm alleges a New York man, a New Jersey man and a business have defaulted on their agreement regarding legal services.

Nelkin & Nelkin P.C filed a complaint on Aug. 30 in the U.S. District Court Eastern District of New York against Steven Schreiber, Eugene Schreiber and Two Rivers Coffee LLC alleging breach of contract and other counts.

According to the complaint, the plaintiff represented the defendants in the Schreiber v. Friedman case in the Eastern District of New York and "obtained a comprehensive and extremely valuable settlement agreement on behalf of the Schreibers and Two Rivers in that case."

The plaintiff holds Steven Schreiber, Eugene Schreiber and Two Rivers responsible because the defendants allegedly failed to pay the fees specified in their engagement letter, failed to pay larger expenses due to vendors, failed to maintain a $5,000 expense deposit with the plaintiff and failed to cooperate with the defendant.

The plaintiff requests a trial by jury and seeks actual damages; other damages, including but not limited to compensatory, and punitive damages; an order directing the Schreibers to pay it one-third of the Schreibers total recovery; prejudgment and post-judgment interest; attorney’s fees; and costs and further relief as this court deems just and appropriate.
