NEW YORK (Legal Newsline) – A consumer claims that the sellers of an insect spray deceive consumers with their all-natural advertising claims.
Qiu-Yun Zhang filed a complaint on behalf of herself and others similarly situated on Aug. 23 in the U.S. District Court for the Southern District of New York against TV Brands Direct Inc., doing business as Green Room Marketing; and Ali Solami, doing business as TV Brands Euco Clean/Euco Clean, citing the New York Consumer Protection from Deceptive Acts and Practices Act and other counts.
According to the complaint, the plaintiff alleges that on July 16, she purchased a container of the defendants' All Natural EucoClean 3-in-1 spray that was advertised as being effective at eliminating fleas, lice, ticks and other insects while being eco-friendly. She alleges the product contains alcohol ethoxylate and cocamido propyl betaine, which are synthetic compounds with material toxicity concerns.
The plaintiff holds TV Brands Direct Inc. and Solami doing responsible because the defendants allegedly deceptively market that the product is free of harsh chemicals and is all-natural.
The plaintiff requests a trial by jury, permanent injunction, statutory damages, attorney fees and costs. She is represented by Mark Schlachet in Cleveland, Ohio.
