Former McDonald's employee alleges consumer report was obtained on him without authorization

BRADENTON, Fla. (Legal Newsline) – A former McDonald's employee alleges the fast food company failed to comply with the strict disclosure and authorization requirements of a federal law regarding consumer reports.

Danny O'Neill, on behalf of himself and all other similarly situated, filed a complaint on July 24 in the 12th Judicial Circuit Court of Florida - Manatee County against McDonald's Corp. alleging violation of the Fair Credit Reporting Act of 1970.

According to the complaint, the plaintiff alleges the defendant procured his and other putative class members' consumer reports for employment purposes without making proper disclosures in a format required by the FCRA or authorization.

The plaintiff alleges he applied for a job with the defendant in March and it procured a consumer report on him.

The plaintiff holds McDonald's Corp. responsible because the defendant allegedly failed to provide a stand-alone document regarding the consumer report information obtained and utilized.

The plaintiff requests a trial by jury and seeks damages, attorneys' fees and costs of suit. He is represented by Marc R. Edelman of Morgan & Morgan P.A. in Tampa, Florida; and Brandon J. Hill, Steven G. Wenzel and Luis A. Cabassa of Wenzel Fenton Cabassa P.A. in Tampa, Florida.
