Excelsior College nursing students seek $10 million in punitive damages over fraud allegations

BROOKLYN. N.Y. (Legal Newsline) – Students of a New York institution allege the school defrauded consumers with the untrue claims of its associate degree in nursing program and are seeking $10 million in punitive damages.

Jessica Willis, et al. filed a complaint on Aug. 13 in the U.S. District Court for the Eastern District of New York against Excelsior College alleging fraud and other counts,

According to the complaint, Willis alleges she enrolled with the defendant in 2015. She alleges the defendant concealed that the passing rate for its $2,300 mandatory test is less than 50 percent and that the wait period was three months from the time of application. 

She alleges she failed the exam and the defendant acknowledged the failure was wrongful, but would not issue her the deserved pass. She alleges she lost a job offer because of this.

The plaintiffs hold Excelsior College responsible because the defendant allegedly willfully and maliciously withheld from them material facts considering the accreditation and pass rate of the final exam.

The plaintiffs request a trial by jury and seek judgment against the defendant, punitive damages in the amount of $10 million, pay lost wages, costs of suit, and attorneys’ fees and further relief as to the court may appear just. They are represented by John Hermina of Hermina Law Group in Laurel, Maryland.
