SAN FRANCISCO (Legal Newsline) – The maker of two brands of nutrition bars is alleged to have misbranded two flavors as containing white chocolate.

Jamie Joslin and Courtney Davis filed a complaint on behalf of themselves and others similarly situated on Aug. 14 in the U.S. District Court for the Northern District of California against Clif Bar & Co. alleging violation of California's Consumer Legal Remedies Act and other counts.

According to the complaint, the plaintiffs allege the defendant wrongfully advertises its Clif Bar White Chocolate Macadamia Nut Bar and Luna White Chocolate Macadamia Bar as containing white chocolate when they do not. They allege the products contain "inferior confectionary ingredients" that are not actual white chocolate.

The plaintiffs allege that they were denied the benefit of their bargain because of the misrepresentation.

The plaintiffs hold Clif Bar & Co. responsible because the defendant's products allegedly do not have the qualities promised.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, prejudgment interest, an order of restitution and all other forms of equitable monetary relief, injunctive relief, attorneys’ fees and expenses and costs of suit. They are represented by David Makman of the Law Offices of David Makman in San Mateo, California; and C.K. Lee of Lee Litigation in New York.
