California Sportfishing Protection Alliance alleges facility is discharging polluting storm water

SAN FRANCISCO (Legal Newsline) – A nonprofit organization alleges a boat repair company is discharging polluted storm water from a California facility.

California Sportfishing Protection Alliance filed a complaint on Aug. 10 in the U.S. District Court for the Northern District of California against Keefe Kaplan Maritime Inc. over alleged violation of the Federal Water Pollution Control Act, or Clean Water Act.

According to the complaint, on June 8, the plaintiff provided notice of defendant's alleged unlawful discharges of polluted storm water from its industrial facility in Richmond, California. 

The plaintiff claims the defendant is discharging polluted storm water and non-storm water that contributes to the impairment of downstream waters and aquatic-dependent wildlife of the San Francisco Bay and local waterways. 

The plaintiff holds Keefe Kaplan Maritime Inc. responsible because the defendant allegedly failed to develop and implement an adequate Storm Water Pollution Prevention Plan for the facility and failed to develop and implement an adequate monitoring and reporting program for the facility.

The plaintiff requests a trial by jury and seeks an order to enjoin the defendant from discharging polluted storm water, award of costs, and such other and further relief as the court may deem appropriate.
