California man alleges makers of Vega products fail to warn of heavy metals

SAN FRANCISCO (Legal Newsline) – A Berkeley, California man alleges the makers of protein products marketed as plant-based failed to disclose the products expose consumers to toxic heavy metals.

Andrew Bland, on behalf of himself and all others similarly situated, filed a complaint on Aug. 7 in the U.S. District Court for the Northern District of California against Sequel Natural LTD, doing business as Vega, and WhiteWave Foods Co. over alleged violation of the California Consumer Legal Remedies Act.

According to the complaint, the plaintiff alleges the defendants' Vega protein powders and protein shakes expose consumers to allegedly heightened levels of lead and cadmium. The plaintiff alleges the defendants provide no warning about the heavy metals in the products.

The plaintiff holds Sequel Natural LTD and WhiteWave Foods Co. responsible because the defendants allegedly misrepresented and/or failed to disclose information about the allegedly heightened levels of lead and cadmium in the products.

The plaintiff requests a trial by jury and seeks award of damages, attorneys' fees, costs of suit, and such other relief as the court deems just and proper. He is represented by L. Timothy Fisher, Joel D. Smith and Thomas A. Reyda of Bursor & Fisher PA in Walnut Creek, California.
