TRENTON, N.J. (Legal Newsline) – An Ohio resident alleges a New Jersey pharmaceutical company is sending unsolicited fax advertisements.
Ruth Ann Cooper filed a complaint individually and as the representative of a class of similarly situated persons on July 23 in the U.S. District Court for the District of New Jersey against Medimetriks Pharmaceuticals Inc. alleging violation of the Telephone Consumer Protection Act and the Junk Fax Prevention Act.
According to the complaint, the plaintiff alleges that she and other similarly situated individuals have suffered damages as a result of receiving unsolicited faxed advertisements from the defendant. She alleges she received a fax from the defendant Feb. 15.
The plaintiff holds Medimetriks Pharmaceuticals Inc. responsible because the defendant allegedly failed to comply with the requirements and regulations of Junk Fax Prevention Act and transmitted an unsolicited advertisement without the prior express invitation or permission from its recipients.
The plaintiff seeks judgment against defendant for injunctive and declaratory relief, statutory damages, attorneys’ fees and costs of suit, interest, and further relief as the court may deem just.
