Consumers claim Tommy Hilfiger outlet store prices are misleading

SAN DIEGO (Legal Newsline) – Two California residents allege that Tommy Hilfiger outlet stores' comparative pricing is false and misleading.

Miguel Olmedo and Siobhan Morrow filed a complaint on behalf of themselves and all others similarly situated on April 18 in the San Diego County Superior Co. against Tommy Hilfiger Wholesale Inc. alleging violation of California's Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act.

According to the complaint, the plaintiffs allege that the defendant uses misleading advertisements of false price discounts at its outlet, factory and company stores. They allege the advertised discount prices are phantom markdowns because the item was never sold at the advertised reference price.

The plaintiffs hold Tommy Hilfiger Wholesale Inc. responsible because the defendant's alleged deceptive marketing practice gives consumers the false impression that the defendant regularly sold products at a higher price than the sale prices and that the branded products were worth more than they actually are.

The plaintiffs request a trial by jury and seek declaratory and injunctive relief as permitted by law or equity, attorneys' fees and costs. They are represented by Todd D. Carpenter, Britanny C. Casola and Edwin J. Kilpela of Carlson Lynch Sweet Kilpela & Carpenter LLC in San Diego, California and Pittsburgh, Pennslyvania.
