FAYETTEVILLE, Ark. (Legal Newsline) – A Casper, Wyoming alleges a Springdale, Arkansas business has placed automated calls to her phone without permission.

Heather Brimmer filed a complaint on June 13 in the U.S. District Court for the Western District of Arkansas, Fayette Division against Dent-A-Med Inc., doing business as HC Processing Center and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges the defendant began calling her within the last year and requested that the calls cease in September 2017. She alleges the defendant continues to place calls to her cellphone despite her request.

The plaintiff holds Dent-A-Med Inc. and Does 1-10 responsible because the defendants allegedly communicated with plaintiff without prior express consent to call and unlawfully utilized an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks judgment against defendants for statutory damages of $500 for each violation, treble damages, and further relief as may be just and proper. She is represented by Sergei Lemberg of Lemberg Law LLC in Wilton, Connecticut.
