Woman alleges firework from Black Cat Marketing, Dave's Wholesale Fireworks exploded prematurely, injured hand

HANNIBAL, Mo. (Legal Newsline) – A Colorado woman alleges a firework she purchased exploded prematurely and caused the amputation of fingers on one hand.

Andrea Marty filed a complaint on June 1 in the U.S. District Court Eastern District of Missouri, Northern Division against Dave's Wholesale Fireworks and Black Cat Marketing USA alleging personal injury.

According to the complaint, the plaintiff purchased a half stick smoking cracker firework from Marty's Fireworks in Wisconsin, which was sold by Dave's Wholesale Fireworks and distributed by Black Cat. She alleges on Sept. 8, 2014, while igniting the firework as intended, it exploded prematurely and severely injured her left hand. The suit states her middle and index fingers on her left hand were amputated and she has lost the majority of her left thumb. 

The plaintiff holds Dave's Wholesale Fireworks and Black Cat Marketing USA responsible because the defendants allegedly distributed and sold a defective and dangerous firework.

The plaintiff requests a trial by jury and seeks a sum of money of more than $75,000 from each defendant. She is represented by Robert B. Patterson of Law Offices of Robert B. Patterson LTD in Chicago.
