Alabama fuel station owner alleges Circle K Stores facility sold fuel below cost

MOBILE, Ala. (Legal Newsline) – An Alabama fuel station owner alleges the operator of another fuel station used illegal practices to injure competitors.

Delta Investments LLC filed a complaint on June 4 in the U.S. District Court for the Southern District of Alabama against Circle K Stores Inc. over alleged violation of the Alabama Motor Fuel Marketing Act.

According to the complaint, the plaintiff operates a Chevron-branded convenience store and gasoline facility in Wilmer, Alabama. The plaintiff alleges that at various times during 2018, the defendant offered to sell and has sold motor fuel to customers at prices that were lower than its cost to retailer as defined by the Alabama Motor Fuel Marketing Act at its Semmes, Alabama Exxon-branded facility.

The plaintiff alleges this action was taken with the intent to injure competitors, including the plaintiff.

The plaintiff seeks preliminary and permanent injunction, reasonable fees, costs and such further equitable relief may be entitled. It is represented by H. Dean Mooty Jr. and Robert S. Mooty of Mooty & Associates, PC in Montgomery, Alabama.
