Murphy USA alleges fuel was stolen at facility in Texas

DALLAS, Texas (Legal Newsline) – A retail gas station operator alleges that several hundred thousand gallons of fuel were stolen and misappropriated in Texas.

Murphy Oil USA Inc. filed a complaint on June 4 in the U.S. District Court for the Northern District of Texas, Dallas Division against Love’s Travel Stops & Country Stores Inc., Gemini Motor Transport, Musket Corp., et al. alleging conversion, theft of property, conspiracy and other counts.

According to the complaint, the plaintiff alleges that in August 2017, the defendants stole more than 220,000 gallons of fuel from it that was stored at a third-party facility in Frost, Texas. The suit states drivers for Gemini accessed the facility and Gemini is the primary fuel hauler for Love's stores. The plaintiff alleges Gemini previously transported fuel for it but had not done so since 2013.

"When confronted by Murphy USA, defendants admitted to their brazen acts of misappropriation without explanation," the suit states.

The plaintiff holds Love’s Travel Stops & Country Stores, Inc., Gemini Motor Transport, Musket Corp., et al. responsible because the defendants allegedly wrongfully exercised dominion and control over the fuel.

The plaintiff requests a trial by jury and seeks judgment against defendants for actual and future damages, exemplary damages, attorneys’ fees and expenses, costs of suit, other relief to which plaintiff may be entitled.
