Woman alleges she returned phones to Verizon, does not owe alleged debt

FORT MYERS, Fla. (Legal Newsline) – A Collier County, Florida woman alleges Verizon is attempting to collect an alleged debt for phones she returned within the cancellation policy.

Laura Cuevas filed a complaint on May 29 in the U.S. District Court for the Middle District of Florida Fort Myers Division against Verizon Wireless Personal Communications LLP, Equifax Information Services LLC, Trans Union LLC and Experian Information Solutions alleging violation of the Fair Credit Reporting Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on March 13, 2016, she purchased new cellular telephones at a Best Buy store for $2,326 and transferred to Verizon as her new cellphone provider. She alleges 14 days later, within the timeframe of the return and cancellation policy, she returned the same and rescinded her Verizon account after not being satisfied with the services. 

She alleges Verizon keeps sending her bills for the phones she returned and contracted debt collectors to collect the alleged debt. The suit also states that the defendant credit unions reported the inaccurate Verizon account on her credit reports and that she has been damaged as a result.

The plaintiff holds the defendants responsible because despite having knowledge that she does not owe the alleged debt, the defendants allegedly demanded payment of $2,326 and continue to report her account as negative.

The plaintiff requests a trial by jury and seeks actual and statutory damages, attorney fees, costs and expenses and all other relief deemed proper. She is represented by Christopher W.
