Trader Joe's sour candy allegedly fails to disclose artificial flavor on package front

SAN DIEGO (Legal Newsline) – A consumer alleges a brand of candy is falsely advertised in California because an artificial flavor is concealed from consumers.

Serena Wong, on behalf of herself and all others similarly situated, filed a complaint on March 22 in the California Superior Court - San Diego County against Trader Joe's Co.; T.A.C.T Holding Inc. and Does 1-5 alleging violation of the Consumer Legal Remedies Act, Unfair Competition Law and other counts.

According to the complaint, the plaintiff alleges the defendants' Trader Joe's Ts and Js Sour Gummies contain an undisclosed artificial flavor and that the product does not disclose this on the front-of-package label. The plaintiff alleges the product contains d-l malic acid.

The plaintiff holds Trader Joe's Co., T.A.C.T Holding Inc.; Does 1-5 responsible because the defendants allegedly failed to label the product in accord with federal and state labeling regulations.

The plaintiff requests a trial by jury and seeks judgment for punitive damages, pre- and post-judgment interest, attorney fees, costs and such and further relief as the court may deem just, equitable and proper. She is represented by Ronald A. Marron and Michael T. Houchin of Law Offices of Ronald A. Marron APLC in San Diego.

The defendant removed the case to the U.S. District Court for the Northern District of California on May 4.
