California Sportfishing Protection Alliance alleges site in state is unlawfully discharging contaminated stormwater

SAN FRANCISCO (Legal Newsline) – A nonprofit benefit corporation alleges that a site that handles the recycling or disposal of public and commercial solid waste is unlawfully discharging contaminated stormwater.

California Sportfishing Protection Alliance filed a complaint on May 9 in the U.S. District Court for the Northern District of California against Republic Services of Sonoma County Inc. alleging violation of the Federal Water Pollution Control Act.

According to the complaint, the defendant operates a 3-acre transfer station in Guerneville, California that the plaintiff alleges discharges pollutant-contaminated stormwater that eventually drains into Pocket Canyon Creek and the Russian River. The plaintiff alleges the defendant violates the Federal Water Pollution Control Act with the discharge of the stormwater.

The plaintiff holds Republic Services of Sonoma County Inc. responsible because the defendant allegedly failed to develop and implement an adequate storm water pollution prevention plan for the facility and failed to develop and implement the best available and best conventional treatment technologies at the facility.

The plaintiff seeks an order for the defendant to take appropriate actions to restore the quality of navigable waters impaired by their activities, award of costs, fees, and any such other and further relief as the court may deem appropriate.
