LOS ANGELES (Legal Newsline) – Two Los Angeles County, California residents allege a brand of dietary supplements is falsely advertised.
Ashleigh Larson and Justin Lovelace, individually and on behalf of all others similarly situated, filed a complaint on March 14 in the Superior Court of California - County of San Francisco against HGGC LLC, also known as Neutraceutical International Group, also known as Zhou Inc. and doing business as Zhou Nutrition, alleging violation of the California's False Advertising Law and other counts.
According to the complaint, the plaintiffs allege that they purchased defendants' dietary supplements, which are advertised to either be "Manufactured in the USA" or "natural." However, plaintiffs claim all of these advertisements are allegedly false and misleading as the product's active ingredients are 85 to 100 percent sourced from outside of the United States and each product contains synthetic ingredients.
The plaintiffs holds HGGC LLC, also known as Neutraceutical International Group, also known as Zhou Inc. and doing business as Zhou Nutrition responsible because the defendants allegedly engaged in a scheme of offering misbranded products for sale by way of advertising its supplements as "natural."
The plaintiffs request a trial by jury and seek temporary, preliminary and/or permanent order for injunctive relief, prejudgment interests, attorneys' fees, and grant any other relief the court may deem just and proper. They are represented by Abbas Kazerounian and Jason Ibey of Kazerouni Law Group APC in Costa Mesa, California and Joshua B. Swigart of Hyde & Swigart in San Diego, California.
The defendant removed the case to the U.S. District Court for the Central District of California on May 2.
