Former Uber driver alleges unwanted texts from company invaded privacy

MIAMI (Legal Newsline) – A Miami-Dade County resident and former Uber driver alleges the ride-hailing service sent him unwanted text messages.

Michael Fridman, individually and on behalf of all others similarly situated, filed a complaint on April 27 in the U.S. District Court for the Southern District of Florida against Uber Technologies Inc. and Rasier LLC over alleged violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff applied to be a driver for the defendants in June 2014 and that the defendants deactivated him in January. He alleges on April 12, he received unsolicited texts from the defendants soliciting him to re-engage as an Uber driver and start using its services. He alleges the texts invaded his privacy and wasted his time.

The plaintiff holds Uber Technologies Inc. and Rasier LLC responsible because the defendant allegedly transmitted text messages to numbers belonging to various individuals using equipment that had the capacity to store or produce telephone numbers to be called, using a random or sequential number generator without prior notice or consent.

The plaintiff requests a trial by jury and seeks actual and statutory damages, injunction and declaratory judgment and such further and other relief as the court deems necessary. He is represented by Avi R. Kaufman of Kaufman PA in Miami.
