DENVER (Legal Newsline) – A Colorado state agency is seeking to compel a business to comply with an order.
Colorado Department of Public Health and Environment filed a complaint on April 25 in the Jefferson County District Court in Colorado against Thoro Products Co. alleging that the defendant violated a compliance order.
According to the complaint, the defendant received on Oct. 19, 2017, a compliance order via certified mail that stated it was in violation of the Colorado Hazardous Waste Act. The plaintiff alleges the defendant allegedly did not submit for its review and approval a modification to the existing approved closure and post-closure plan within 60 days of the compliance order's effective date. The compliance order also required the defendant to pay an administrative penalty of $11,365 within 30 days of the effective date.
The plaintiff holds Thoro Products Co. responsible because the defendant allegedly violated the compliance order and still remains in violation.
The plaintiff seeks to compel the defendant's compliance with the order, award all costs and provide such other relief as the court deems appropriate. It is represented by Colorado Attorney General Cynthia H. Coffman and Assistant Attorney General Lukas Staks in Denver.
