SEATTLE (Legal Newsline) – A nonprofit corporation involved in the protection of the waters of Puget Sound in Washington alleges a company has violated the Clean Water Act.
Puget Soundkeeper Alliance filed a complaint on April 12 in the U.S. District Court for the Western District of Washington at Seattle against Total Terminals International LLC citing the Clean Water Act.
According to the complaint, the plaintiff alleges that the defendant has violated the effluent standards and limitations under the Clean Water Act and the terms of its National Pollutant Discharge Elimination System.
The plaintiff holds Total Terminals International LLC responsible because the defendant allegedly violated the permits by contributing to violations of water and sediment quality standards, failed to monitor discharges, failed to implement best management practices to control stormwater quality.
The plaintiff seeks judgment against defendant, declaratory and injunctive relief, pay civil penalties of $37,500 per day of violation, litigation expenses, including attorneys’ and expert witness fees, and other relief as the court deems appropriate.
