LOS ANGELES (Legal Newsline) – A Los Angeles County man alleges a debt collector has harassed him with calls.
Miguel Napoles filed a complaint individually and on behalf of all others similarly situated on April 10 in the U.S. District Court for the Central District of California against Dent-A-Med Inc., doing business as HC Processing, and Does 1-10 alleging violation of the Telephone Consumer Protection Act.
According to the complaint, Dent-A-Med began calling the plaintiff's cellphone in April 2017 in an attempt to collect an alleged debt. The plaintiff alleges the defendant did not have his consent to contact him.
The plaintiff holds Dent-A-Med Inc. and Does 1-10 responsible because the defendants allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff using an automatic telephone dialing system and caused a telephone to ring repeatedly or continuously with intent to annoy him.
The plaintiff requests a trial by jury and seeks judgment against defendants for statutory damages of $500 for every violation and treble damages of $1,500 for every willful violation, and other relief that the court deems just.
