WILMINGTON (Legal Newsline) – A New York consumer has filed a class-action lawsuit against a department store over allegations her private information was exposed as a result of inadequate security.

Bernadette Beekman, individually and on behalf of all others similarly situated, filed a complaint on April 5 in the U.S. District Court for the District of Delaware against Lord & Taylor LLC alleging negligence and other counts.

According to the complaint, criminal syndicate JokerStash announced March 28 that it had released for sale more than 5 million stolen credit and debit card accounts and that a cybersecurity firm determined the breach involved cards used at the defendant's stores and others.

The plaintiff alleges her information and class members' information was stolen by the hackers.

The plaintiff holds Lord & Taylor LLC responsible because the defendant allegedly failed to implement adequate security systems, protocols and practices sufficient to protect customers' private information and thereby creating a foreseeable risk of harm.

The plaintiff requests a trial by jury and seeks order for the defendant to pay actual and punitive damages, attorneys' fees, litigation costs, pre- and post-judgment interest, and order such other and further relief as may be just and proper. She is represented by Ralph N. Sianni of Andersen Sleater Sianni LLC in Wilmington, Delaware and Janine Pollack and Daniel Tepper of Wolf Haldenstein Adler Freeman & Herz LLP in New York.
