American Express Travel Related Services alleged to have failed to honor promotional offer

CHICAGO (Legal Newsline) – A credit card company is alleged to have failed to provide a Chicago individual statement credits as advertised in a promotional offer.

Ilya Vasilyev and Ivig Trucking Co., individually and on behalf of all others similarly situated, filed a complaint on Feb. 20 in the Cook County Circuit Court against American Express Travel Related Services Co. Inc. and Does 1-10 over alleged violation of the Illinois Consumer Fraud and Deceptive Business Practices Act and other counts.

According to the complaint, the plaintiffs applied for a SimplyCash Plus Business Credit Card offered by defendant in January 2017. The plaintiffs allege at the time they applied for the card, the defendants offered a promotion of $300 statement credit after account holders spent a total of $5,000 on the said credit card within three months and an additional $200 statement credit with spending a total of $10,000 within six months. 

The plaintiffs claim the offer was false as they later were advised by defendant's agent that the promotional offer did not apply to their credit card account. As a result, they allege they lost credits totaling of $500 and suffered stress, aggravation and inconvenience.

The plaintiffs holds American Express Travel Related Services Co. Inc. and Does 1-10 responsible because the defendants allegedly failed to honor its promotional offer and provide the statement credits as promised.

The plaintiffs request a trial by jury and seek award of actual and punitive damages, attorneys' fees, litigation costs, related expenses incurred, pre- and post-judgment interest and such other and further relief as the court may deem just and proper. They are represented by David B. Levin of Law Offices of Todd M. Friedman PC in Chicago.

The defendant removed the case to the U.S. District Court for the Northern District of Illinois on March 23.
