AUSTIN, Texas (Legal Newsline) – A Texas resident alleges a security hole in T-Mobile's system allowed hackers access to his personal information.

David Reza Piri filed a complaint on March 29 in the U.S. District Court for the Western District of Texas, Austin Division against T-Mobile US Inc. and T-Mobile USA Inc., alleging breach of contract, negligence and other counts.

According to the complaint, the plaintiff has been a T-Mobile customer since 2002. The suit states on May 10, 2017, his T-Mobile account was exploited by hackers who obtained his "personal confidential information then used this information via social engineering to impersonate him and port his phone number into their possession."

The plaintiff holds T-Mobile US Inc. and T-Mobile USA Inc. responsible because the defendants allegedly failed to provide the requisite physical, technical and administrative safeguards intended to protect users' accounts and personal identifying information.

The plaintiff requests a trial by jury and seeks judgment for actual, economic and mental anguish damages; treble damages; attorney's fees; costs; pre- and post-judgment interest, and such other relief as the court deems just and proper. He is represented by Austin F. Pennington of The Pennington Firm PC in Dallas.
