Taste of Nature alleged to use non-functioning slack-fill in candy boxes

LOS ANGELES (Legal Newsline) – A Redondo Beach, California woman alleges that a candy manufacture is packaging its products in boxes with non-functional slack-fill.

Sierra Gillespie, individually and on behalf of herself and others similarly situated, filed a complaint on March 13 in the U.S. District Court for the Central District of California against Taste of Nature Inc. alleging unfair and unlawful business practices and deceptive advertising.

According to the complaint, the defendant manufactures Chocolate Chip Cookie Dough Bites, Fudge Brownie Bites and other candies. The plaintiff alleges that on Aug. 25, 2017, she purchased defendant's various candies for $1 each. The plaintiff alleges that the candies are packaged in a box that contains a large amount of non-functional slack-fill.

The plaintiff holds Taste of Nature Inc. responsible because the defendant allegedly made uniform and materially false representations and omissions regarding the products’ packaging by including substantial non-functional slack-fill to derive financial gain at the expense of accuracy or truthfulness.

The plaintiff requests a trial by jury and seeks judgment for appropriate, compensatory and monetary damages, restitution or disgorgement, attorneys' fees, costs, pre- and post-judgment interest, and such other and further relief as the court deems just and proper.
