Passengers allege Volaris Airlines flight delay caused them to miss travel plans

CHICAGO (Legal Newsline) – Four airline passengers allege that they suffered a loss of vacation time because their flight from Chicago to Mexico was delayed three hours.

Galina Chimanski, Vassili Govorovski, Marina Feoktistova and Vladimir Shtern filed a complaint on March 6 in the U.S. District Court for the Northern District of Illinois against Volaris Airlines citing the Montreal Convention for the Unification of Certain Rules for International Carriage by Air.

According to the complaint, the plaintiffs allege that on Dec. 17, 2017, they purchased four international air fare tickets for international transportation on Jan. 6 with the defendant from Chicago to Mexico. The plaintiffs allege during the flight, they were subjected to a delayed departure and were confined within the airplane with no access to lavatories, food or water and medicines. They also allege they missed their pre-arranged travel plans at Huatulco, Mexico because of the delayed arrival. 

As a result, the plaintiffs claim they suffered actual monetary loss amounting to $2,500 per passenger. 

The plaintiffs request a trial by jury and seek actual and general damages in the sum of $6,623.15 per passenger, award of attorney’s fees, disbursements, and such other and further relief as the court may deem just and proper.
