CAMDEN, N.J. (Legal Newsline) – An information management company that provides medical records storage is alleged to have unlawful billing policies.

Kasher Law Group LLC filed a complaint on behalf of itself and all others similarly situated on Dec. 11 in the Camden County Superior Court of New Jersey against Ciox Health LLC citing the New Jersey Uniform Declaratory Judgment Act and other counts.

According to the complaint, the plaintiffs allege that it and class members have suffered loss of money and property as a result of defendant's unlawful business practice of forcing plaintiff to pay an amount higher than permitted by law for copies of medical records. 

The plaintiff holds Ciox Health LLC responsible because the defendant allegedly collected fees for copies of medical records at a cost that exceeded the maximum legal limit and received benefit in the form of unlawful fees at the expense of plaintiffs.

The plaintiff seeks judgment against the defendant, certify the proposed class, injunctive and declaratory relief, interest, attorneys' fees, costs, treble and punitive damages, and further relief as the court deems just. It is represented by Stephen P. DeNittis, Joseph A. Osefchen and Shane T. Prince of DeNittis Osefchen Prince PC in Marlton, New Jersey.

The defendant removed the case to the U.S. District Court for the District of New Jersey on Feb. 8.
