Consumer alleges financial injuries over alleged slack-fill in 50-cent box of Sixlets candy

WHITE PLAINS, N.Y. (Legal Newsline) – A New York consumer has filed a class-action lawsuit over allegations she was financially injured after purchasing a 50-cent box of chocolate candy because she did not receive the quantity she paid for and was promised.

Dominique Green filed a complaint on behalf of all others similarly situated on Feb. 1 in the U.S. District Court for the Southern District of New York against Sweetworks Confections LLC alleging violation of the New York Deceptive and Unfair Trade Practices Act and other counts.

According to the complaint, the plaintiff alleges that the defendant packages its Sixlets chocolate candy in nontransparent boxes with 60 percent slack-fill, most of which is nonfunctional. She alleges the size of the box makes it appear to consumers that they are purchasing more candy than what is actually being sold.

The suit states the plaintiff purchased a box of Sixlets on Dec. 29, 2017, for 50 cents.

The plaintiff seeks restitution and disgorgement, interest, compensatory and other damages, actual and statutory damages, order the defendant to immediately cease its wrongful acts, enjoin the defendant, court costs, and any further relief the court grants.
