ORLANDO (Legal Newsline) – An Orlando law firm claims that a Fort Lauderdale firm and Miramar individual are unlawfully using its name for advertising.
Daniel J. Newlin, P.A., doing business as The Law Offices of Dan Newlin & Partners, filed a complaint on Dec. 28, 2017, in the 9th Judicial Circuit Court for Orange County, Florida against The Attorney Law Group Inc. and Juan Ruiz, Esq. alleging unauthorized use of name for advertising, false advertising and other counts.
According to the complaint, the plaintiff provides legal services to victims of personal injury resulting from vehicle collisions or other incidents. It alleges the defendants are buying the term Dan Newlin to make their online advertisements appear on top or below the plaintiff's web advertising to confuse consumers.
The plaintiff holds The Attorney Law Group Inc. and Ruiz responsible because the defendants allegedly used the plaintiff's name for advertising and caused injury to the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, lost profits, injunction against the defendant, court costs and any further relief the court grants. It is represented by Richard S. Dellinger of Lowndes, Drosdick, Doster, Kantor & Reed PA in Orlando, Florida.
The defendant removed the case to the U.S. District Court for the Middle District of Florida on Jan. 26.
