Royal Caribbean Cruises employee alleges she was assaulted on cruise ship

MIAMI (Legal Newsline) – A resident of Argentina employed by Royal Caribbean alleges she was sexually assaulted by another co-worker while working on the Majesty of the Seas.

Jane Doe filed a complaint on Dec. 22, 2017, in the 11th Judicial Circuit Court for Miami-Dade County, Florida against Royal Caribbean Cruises LTD alleging intentional infliction of emotional distress and other counts.

According to the complaint, the plaintiff alleges that she was physically injured when she was sexually assaulted while on board the Majesty of the Seas on Dec. 29, 2015, by an inebriated co-worker. She alleges she reported the incident and was examined by the onboard physician after the attack and reported the incident Dec. 30, 2015, to police in the Bahamas, which was the next port of call. She alleges her supervisor "urged" her not to press charges, so she did not. She alleges the defendant never reported the assault to U.S. authorities.

The plaintiff alleges that after reporting the attack, the defendant intimated and belittled her and denied her appropriate medical care.

The plaintiff holds Royal Caribbean Cruises LTD responsible because the defendant allegedly failed to provide her a safe place to work and negligently hired crew members with dangerous propensities.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, loss of income and wages, court costs and any further relief the court grants. She is represented by John H. Hickey and Kathleen Phillips of Hickey Law Firm PA in Miami, Florida.

The defendant removed the case to the U.S. District Court for the Southern District of Florida on Jan. 22.
