Law firm seeks more than $150,000 from Windstream Communications over phone service

FORT LAUDERDALE, Fla. (Legal Newsline) – A Deerfield Beach, Florida law firm alleges a phone service provider failed to provide functional service.

The Tickin Law Group PLLC filed a complaint on Jan. 3 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Windstream Communications LLC alleging breach of contract and negligence.

According to the complaint, the plaintiff contracted the defendant bundled telecommunications services in October 2008. It alleges in 2014, the law firm began experiencing serious problems with its telephone system, including large amounts of dropped calls and the inability of the phone service to maintain connections for incoming voice calls.

The plaintiff claims that after months of troubleshooting, it was able to contact an employee of the defendant who attributed the issues to the defendant's servicing software.

The plaintiff holds Windstream Communications LLC responsible because the defendant allegedly failed to provide usable telecommunications services and permitted the inoperable services for more than six months. The plaintiff alleges it lost business revenue.

The plaintiff seeks judgment for monetary damages in the amount of $150,000, plus all interest accrued, costs, attorney's fees, costs and such other relief as the court may deem just and proper.
