SAN FRANCISCO (Legal Newsline) – A California woman alleges a brand of milk products are falsely advertised as organic.
Crystal Brown filed a complaint on behalf of herself and all others similarly situated on Dec. 27, 2017, in the U.S. District Court for the Northern District of California, San Francisco Division against Danone North America LLC and The WhiteWave Foods Co. alleging violation of the Consumers Legal Remedies Act and the Unfair Competition Law.
According to the complaint, the plaintiff alleges that the defendants falsely and deceptively advertised their Horizon Organic Milk plus DHA Omega-3 products. The plaintiff alleges that the products are not certified organic as advertised because the DHA added to the product is not organic and is not an additive that may be included in certified organic products.
The plaintiffs request a trial by jury and seek judgment against defendants, injunctive relief, declare this suit as a class action, designate class representative and class counsel, award restitution, attorneys’ fees, expenses, costs, interest, and other relief as may be just and proper.
